Standard Terms and Conditions for AP Gardens and Landscaping Work.
For the purposes of this document you are referred to as “the client”
We, Adam and employees of AP Gardens and Landscapes, are henceforth known as “Adam”.
All projects and subscriptions will be subject to agreement on inspection, before work commences, this will be via a visit free of charge.
The client will be responsible for all payments to AP Gardens & Landscapes unless otherwise notified in writing prior to commencement.
Please note:
The client must pay the full materials price upfront so that a delivery can be arranged. Half of the quoted labour price MUST be paid during the first day of work. Once the job is complete, the other half of the quoted labour price must be paid within 24hrs of Completion. Failure to pay within this time frame may incur a late payment fee.
Should personal circumstances of the client, Adam or other external factors such as weather conditions affect the progression of a job, the client is liable to pay for the work carried up to the point in delay.
Any addition and/or alterations to the schedule shall be properly treated as variations and subject to increased costs.
At AP Gardens and Landscapes, we do not provide a guaranteed finishing date or guaranteed timeline due to the nature of our work and due to the fact that we work with other companies with their own timelines. Weather conditions can also impact this.
The client shall provide water and electricity at no charge.
The client shall provide access to site during Adam’s normal working hours and storage space for materials during the contract progress if required.
If access is not available a cancellation charge of no less than £50 will apply.
Cancellations must be made 24 hrs before the scheduled visit.
Late cancellation fees will be applied based on individual circumstances and will range from £10 to £50.
Scheduled sessions will be rearranged, if Adam cancels due to unforeseen circumstance or adverse weather conditions, your scheduled session will aim to be re-booked within 7days or other agreeable time span.
Adam is not able to accept responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection
All or any special conditions, of which Adam has been informed, are noted in the quotation.
Payment of invoice is to be made by before the start of the project or in instalments. This requires materials to be paid for before the confirmed start of the project. On the commencement of the project, the second instalment is required. Final payment will be on completion of the project.
Payments must be made within 24hrs to avoid a late payment fee of up to £100 per day.

All materials on site remain the property of Adam until payment is received in full. Adam reserves the right to visit the property and take back some materials to cover losses should the client fail to make payment in full.
It is very important and the responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
We accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.
We are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.
When living plant material is purchased and planted by Adam, the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established.
All plant, materials sales and deposits are final and non refundable.
Severe weather conditions, including drought, may cause the delay of the start date of the contract.
Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstances.
The client will be responsible for clearing up all faeces in the garden prior to the arrival of Adam. Failing to do so will result in the area affected being left undone, (as an example, grass won’t be cut if faeces is on grass), but the full hourly rate will still apply. Repeated events of faeces in the working area will result in no work being performed and a call-out charge of no less than £50 being applied.
Under the terms of the Consumer Rights Act 2015, you have the right to cancel within 14 calendar days starting on the date you agree/sign the contract, during which time you may cancel the contract without paying a penalty. This is known as the ‘cooling off period’. The law that governs the length of ‘the cooling off’ period is the Consumer Contract (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. If you cancel the contract we will reimburse to you all payments received from you, including where applicable, any deposit paid to us.
You may request us to begin work during the cancellation period. If you later decide to cancel, you shall pay us a reasonable amount to take account of the work carried out until cancellation is communicated to us. Please see guidance here:

If you do wish to cancel please contact Adam on 07756756103 and state specifically that you wish to cancel.
Adam has the right to cancel any client without any notice or written explanation. This can include if the client has lost faith and/trust in AP Gardens and Landscapes. This can also include if there is a delay in payment.
Adam will not tolerate any abuse or inappropriate behaviour and has the right to withdraw services in these circumstances without notice.
We reserve the right to change these terms and conditions at any time.
